CONSTITUTION AND BY-LAWS

OF CLEARWATER VALLEY HIGH SCHOOL

Kooskia, Idaho

 

Preamble

 

We, the students of Clearwater Valley High School, in order to establish a representative form of government, encourage good citizenship, promote student activities and assure for succeeding classes a responsibility for the welfare and good order of the school, do ordain and establish this constitution for Clearwater Valley High School of Kooskia, Idaho.  Revised February 14, 2002.

 

 

ARTICLE I

 

(Name of organization and membership)

 

Section I

This organization shall be known as the Clearwater Valley High School Student Body.

 

Section II

            Membership and full privileges of this organization shall be granted to all students who abide by this constitution and pay such dues as may be required here in.

 

Section III

            Dues for all members of the Clearwater Valley High School Student Body shall be set each year by the principal of the school, payable upon registration, in return for which a student activity card shall be given, entitling the student to admission to all home athletic contests. Student body officers must be paid members.

 

 
 

ARTICLE II

 

(Officers, their duties and powers)

 

Section I

            The officers of the student body shall consist of a president, vice-president, secretary, treasurer, and spirit leader.  The spirit leader will work in conjunction with the cheerleading squad.

 

 

Section II

            The president shall preside at all student body meetings and all meetings of student council.

 

Section III

            The president shall have power to appoint all student body committees and other appointees as he/she deems necessary, which in turn shall be approved by a 2/3 vote of all the student council members at any regular or special meeting.

 

Section IV

            The vice-president shall preside in the absence of the president and, while presiding, shall be vested with all powers inherent to that of the president.

 

            The vice-president shall act as publicity manager for the high school activities.

 

Section V

            The secretary shall keep a written record of all meetings of the student body and of the student council, and act as custodian of the constitution.

 

Section VI

            The treasurer shall act as accounting manager of student body funds for the student council.

 

Section VII

            The spirit leader shall be in charge of all pep assemblies, homecoming activities, and special activities for sporting events.

 

 

ARTICLE III

 

(Officers—their nomination, election and tenure)

 

Section I

            All officers of the organization shall be selected from the student body at large.  The president may be a member of the Junior or Senior Class during his or her term of office.  The vice-president, secretary, treasurer, and spirit leader must be a Sophomore, Junior, or a Senior.

 

A.     Candidates for officers of this student body shall be nominated by petition signed by the candidate giving his/her acceptance, including ten student body members’ signatures, and shall be approved by a majority of the faculty.  No candidate may circulate a petition for more than one office.  No student may sign more than one petition for the same office.

 

B.     Candidates nominated shall have their names placed on an open ballot to be submitted to the student body at the election.

 

C.     All petitions for the purpose of nominating student body officers as provided for shall be turned into the election board no later than one week preceding the election, which shall be scheduled each Spring by the principal.

 

Section II

A.     An election board shall conduct student body elections.  The Election Board will consist of the current Associated Student Body officers and a faculty member appointed by the principal. The student body president shall preside as a judge and the other student body officers shall be clerks.  One clerk shall distribute the ballots and the other shall check names of qualified voters from a list provided by the principal.

 

B.     A student running for an office for the following year may not serve on the election board.

 

C.     Ballots shall be deposited in a ballot box. Immediately following the election, the election board shall count the ballots.

 

D.     Eligible voters will consist of students who have paid for their activity card and are currently enrolled in grades eight, nine, ten, and eleven that attend Clearwater Valley School.

 

E.      Acceptable areas for campaign propaganda will include the high school building including the gymnasium., but excluding any designated classroom areas. areas.

 

Section III

            All student body officers shall hold office for one school year immediately beginning the day following the election.  If a student body office is vacated for any reason, there shall be an election held within two weeks to fill the vacancy.  If the student body president’s office is vacated the, vice-president shall become president, and there shall be an election for vice-president, provided there are three or more months left in the school term.

 

Section IV

            Individual Class election campaigning may begin the day after final ASB election results.

 
 

ARTICLE IV

 

(The Student Council and Meetings)

 

Section I  

            The officers of the student body, class presidents, and one representative of each class shall constitute the student council, which shall be the governing body of this organization.

 

Section II

            The student council shall meet at the call of the president, who shall also call such meetings of the general student body as are necessary.

 

Section III

A.     The student council shall have jurisdiction over all student organizations of the school, and no organization shall exist or be identified within Clearwater Valley High School without the sanction of the student council.

 

B.     All student organizations in existence at the time of the adoption of the constitution, shall be recognized by the student council providing they have a written constitution in the hands of the student council, and it has been accepted by the council.

 

C.     Any group desiring to organize for any purpose shall submit to the student council an application for recognition, stating name, purpose and tentative membership of the proposed organization, accompanied by a statement of willingness to abide by the constitution and its by-laws.  Recognition shall be given by the student council if in their opinion the proposed organization would be consistent with the best interests of the school.

 

Section IV

            The student council shall have power with the consent of the principal.

 

1.      To levy assessments upon the student body members.

 

2.      To appropriate money from the general fund of the student body for school needs.

 

3.      To originate and provide plans for raising of money for student body use.

 

4.      To establish laws to safeguard the property of the school and of the members of the student body.

 

5.      To make all laws necessary to carry out the purpose of this constitution as expressed.

 

Section V

A.     Student council members are expected to attend all meetings called by the president.

 

1.      If a member misses more than 2 meetings in any school-year quarter, that member will be subjected to a disciplinary hearing. 

 

2.  If said member fails to abide by requirements determined at the disciplinary hearing, he/she is subject to impeachment.

 

Section VI

 

Impeachment process of any ASB officer includes steps taken in the following order:

 

1.   Call for a hearing from a student council member conducted by the student council to discuss the reason for impeachment.  This meeting will also consider whether to take disciplinary action, or to continue with the impeachment process.

            A.      Disciplinary action may consist of, but not be limited to, one detention issued on the third tardy to a meeting, and one detention for every tardy after 3 in any one 9 week period.

 

2.      Unanimous Vote, not including the officer in question, of the student council.

 

 

ARTICLE V

 

Section I

            The constitution and by-laws of this organization may be amended by a two-thirds vote of the student body at any election called for said purpose.  Voting of the amendments shall be by ballot, which ballot shall contain the question “Shall ___________ be amended to read as follows __________?”   The full text of the section with proposed amendment, and proper circles or squares in which to indicate an affirmative or negative vote.

 

Section II

            Proposed amendments to the constitution and by-laws shall be submitted to the student council in writing.  If approved by a majority vote of the student council, amendments shall be submitted to the student body for election within thirty days.

           

Article I

            Robert’s Rules of Order shall govern this association in all cases where they are applicable and when they are not inconsistent with the provisions of this constitution and by-laws.

 

Article II     

            The official school colors of Clearwater Valley High School shall be RED, WHITE, and BLACK.

 

Article III 

            The official insignia of Clearwater Valley High School shall be the Ram.  All athletic teams of the school shall be designated as the Clearwater Valley Rams.

 

Article IV

            Major sports in Clearwater Valley High School shall be football, basketball, softball, baseball, tennis, track, wrestling, volleyball, and cheerleading.

 

Article VI

            To qualify for a letter in basketball, football, softball, baseball, tennis, track, wrestling, volleyball, and cheerleading, a player must fulfill the requirements determined by the coaches.

 

Article VII

            To qualify for a manager’s letter award, a team manager must fulfill the requirements as determined by the coaches.

 

Article VIII

            No person should be allowed to wear a letter jacket with a letter on it that has not been duly awarded to him or her.  A person cannot wear a letter jacket with a letter on it from another school.  However, the jacket may be worn if the letter has been removed.  A person may not sew on a chevron until the letter has been awarded to them.  All organizations shall be responsible for the wearing of their awards.

 

Article IX

The rules and regulations of the Idaho High School Activities Association shall govern all extra-curricular activities of Clearwater Valley High School.

 

Article X

            The Pep Club and Cheerleaders shall be under supervision of a faculty member appointed by the principal.

 

Article XI

            The band shall be under the direction of the music department.  Awards will be made on the point system.

 

Article XII

            The yearbook of Clearwater Valley High School shall be the RAM.  The advisor shall be appointed by the principal.  Selection of the editor will be based on experience and merit as determined by the principal, advisor, and members of the yearbook staff.  The RAM shall be a Fall delivery yearbook.
